What are the Tennessee and Mississippi Statute of Limitations?

People are always asking me how long they have to pursue legal action in a personal injury case before the statute expires, while other people don’t really know what it means when their insurance company tells them the statute of limitation has expired.  Luckily, the answer is clear and simple: for a personal injury case, you have the following amounts of time to pursue legal action in your case:

Tennessee: 1 year

Mississippi: 2 years

Keep these time limits clearly in mind, especially if you are dealing with an insurance company – often, those companies will do all they can to extend your process of recouping money until after your statute of limitations expires, meaning that you are no longer able to pursue any legal action in your case.  If you feel like you are being strung along by insurance or another company, I strongly encourage you to seek legal advice.  

What kind of cases do we accept?

When you're a good Memphis personal injury lawyer you get lots of phone calls and there are a lot of decisions that have to be made concerning what type of cases you should take on and dedicate your time to, and which ones you should turn down.

We're not like most other Tennessee or Mississippi law firms. Our accident and injury cases are NOT handled primarily by paralegals or assistants. It's important to know this because each and every day we get calls from throughout Memphis and the rest of Tennessee and Mississippi from people wanting us to represent them. Unfortunately we don't have the time to accept each and every one of these potential clients. So when you call or email our office and want us to represent you in your lawsuit please have the following information available:

 

  • When did the car wreck, truck accident, dog bite or slip and fall occur?
    • Mississippi and Tennessee both have a statute of limitations that limit the amount of time you have to file a lawsuit after an accident or injury occured. In Tennessee that time is one year, and in Mississippi that time limit is two years. If you have procrastinated and decided to wait and try to file your claim a few weeks before the statue of limitations run we're sorry but we will not take your case.
  • What type of damage did you suffer in the accident?
    • Before we will take your case there must be some type of injury or damage to you and your body. This means you must be suffering some type of bodily injury that has caused you to go to the doctor or hospital or that makes you need to go to the hospital or doctor. Damage to your car or property alone is not enough for us to take your case.
  • Did another attorney already start work on your case and now you want to use us?
    • We will not accept any cases where another attorney has already been contracted by you to work on your accident case, even if you aren't happy with them and would like us to take over. When someone else has already been involved in your case it is too difficult for us to know what has already occurred and what hasn't. We will not walk into problems that someone else may have created. It takes too much time away from our current client's cases. If you were our client you wouldn't want us to take time away from your case to try and solve the problems another attorney created on someone else's case would you?
  • Do you feel your case is ethical?
    • Here at my firm we use the golden rule to guide us; "Do unto others as you would have others do unto you?" - Matthew 7:12. Use your morals before giving us a call. If your case is based on loose facts and evidence, and even looser morals turn to the back of the phone book and call one of those guys. We will not take your case. But If you've been seriously injured because of the true negligence of someone else, we are here to help you, and we will fight till the end to make sure that you absolutely get everything you deserve. There is no gray area for us here.
